| RECOMMENDATION: |
It is recommended that the City Council: 1. Authorize the transfer of $723,444.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $723,444.00 from available funds; and 3. Authorize the City Manager to execute a contract with Conatser Construction TX, LP, in the amount of $662,444.00 for Sanitary Sewer Rehabilitation Contract M-1-I-1, Part 2. |

| DISCUSSION: |
On July 27, 2001, (M&C C-18456) Council authorized the City Manager to execute an Engineering Agreement with Dunaway Associates, L.P., for Sanitary Sewer Main 1-I-1 Condition Assessment and Drainage Area Evaluation Study. This project, Part 2, consists of the rehabilitation of a sanitary sewer main from Shamrock Avenue to Northeast Seventh Street. The project was advertised for bid on July 30, 2009, and August 6, 2009, in the Fort Worth Star-Telegram. Schultz, Inc., | $1,085,110.00 | | | d/b/a Circle "C" Construction Company | | | M/WBE - Conatser Construction TX, LP, is in compliance with the City's M/WBE Ordinance by committing to 25 percent M/WBE participation. The City's goal on this project is 24 percent. In addition to the contract cost, $36,000.00 is required for construction staking, project management, material testing and inspection and $25,000.00 is provided for project contingencies. The project is located in COUNCIL DISTRICT 2. |

| FISCAL INFORMATION/CERTIFICATION: |
The Financial Management Services Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund. |
