SUBJECT:  

Authorize the City Manager to Initiate Rezoning of Certain Properties in Phase Three of the West Meadowbrook Neighborhood in Accordance with the Comprehensive Plan


RECOMMENDATION:

It is recommended that the City Council authorize the City Manager to initiate certain zoning changes in Phase Three of the West Meadowbrook neighborhood, as depicted in Attachment A, in accordance with the Comprehensive Plan.

 
DISCUSSION:

On November 21, 2000, the City Council received Informal Report No. 8289, regarding procedures for City Council-initiated rezoning of properties to make the City's zoning districts more consistent with the adopted Comprehensive Plan. The procedures involve:
  
1. Verifying that the zoning changes are consistent with the City's Comprehensive Plan;
  
2. Allowing interested Council Members to conduct one or more informational meetings in or near the proposed zoning districts in order to explain the proposed changes to affected property owners;
  
3. Briefing the City Council on the proposed zoning changes, after which the City Council shall indicate whether or not it wishes to initiate those proposed changes; and
  
4. Placing an appropriate Mayor and Council Communication (M&C) on the agenda for the next regular City Council meeting authorizing the Planning and Development Department to prepare an appropriate rezoning application and schedule the application for the next available public hearing by the Zoning Commission.
  
Council Member Kathleen Hicks has requested that the City Manager initiate the process for rezoning property in the West Meadowbrook neighborhood, as depicted in Attachment A. This portion of the West Meadowbrook neighborhood is generally bounded by Interstate Highway 30, Edgewood Terrace, East Lancaster Avenue and Oakland Boulevard. The neighborhood consists primarily of single family residential, duplexes, institutional and commercial uses and vacant land that is designated as single-family, institutional, neighborhood commercial and public park in the 2009 Comprehensive Plan. The properties in this section of the West Meadowbrook neighborhood are currently zoned "A-21" One-Family, "A-5" One-Family, "B" Two-Family, "C" Medium Density Multifamily, "CF" Community Facilities and a mixture of commercial districts, as well as various historical and cultural overlay districts, as depicted in Attachment B. Based on existing land uses, as well as on land use policies in the 2009 Comprehensive Plan, staff recommends rezoning the area to "A-21" One-Family, "A-10" One-Family, "A-7.5" One-Family, "A-5" One-Family, "B" Two-Family, "CF" Community Facilities, "ER" Neighborhood Commercial Restricted, "E" Neighborhood Commercial and retaining the existing historical and cultural overlays.
  
Neighborhood representatives met regarding the proposed zoning changes on August 17, 2009. Two persons in opposition have been noted to date. The City Council received an Informal Report on October 27, 2009, describing the proposed zoning changes.
  
Approval of the M&C will allow the City Manager to submit a rezoning application for a public hearing by the Zoning Commission on December 9, 2009, and if recommended for approval, for public hearing and action by the City Council on January 5, 2010.

  
The subject property is located in COUNCIL DISTRICT 8.
