Planned Developments     Article 3

Purpose

The Planned Development (“PD”) District is intended to provide for greater flexibility in the development of residential, commercial, industrial, and institutional uses. The “PD” District is intended to allow for a more creative district, especially for unique properties, through regulations and a mix of land uses that might not be possible under conventional district regulations.  The PD also is utilized to impose additional restrictions or remove permitted land uses from a proposed development.

The PD is a useful tool for redevelopment by providing a method to ensure that new land uses and their external effects such as traffic, signage, and parking, are developed to minimize any potential negative affects on adjacent properties.  Through the use of site plans, which are approved through the ordinance, the details of the development are understood by all involved.  This committment to the specifics of a development provides a predictability for the project. 

All applications for a Planned Development must be accompanied by a site plan. The site plan will be processed as part of the zoning case and not as a separate case. The detailed list of required contents for a site plan is included within the application and provided below. The site plan is adopted as part of the ordinance for the zoning change, and any deviation from this adopted plan other than that stated in Section 403.3B of the Zoning Ordinance may require processing of a new zoning case and reapproval by the Zoning Commission and City Council.

The site plan requirement may be waived only by approval of the Zoning Commission and City Council.

Uses Requiring a PD

Certain uses may be permitted only through review and approval of a Planned Development designation.  Section 4.305 of the Zoning Ordinance provides the uses that require a PD and the specific criteria that must be met and provided on the site plan.  Examples include: halfway houses, hotels and motels within 1000 feet of a residential district, certain heavy industrial uses, and recycling facilities.
