8.100 Enforcement Agent

It shall be the duty of the City Manager, through the proper department, to enforce this Ordinance.


8.101 Violations and Penalties

  1. Maximum Fine
    Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than $2,000.00 for each offense.  Each day that a violation is permitted to exist shall constitute a separate offense.
  2. Minimum Fine:  One Previous Conviction Within Three Years
    If it is shown on trial of an alleged offense under this ordinance that within three years prior to the alleged offense date the defendant has been once previously convicted of an offense under this ordinance.
    1. Except as provided by subsection 2 below, upon conviction the defendant shall be fined not less than $250.00.
    2. If it is also shown on trial of the alleged offense that the defendant was not a residential occupant of the property involved at the time of the alleged offense, upon conviction the defendant shall be fined not less than $1,000.00.
  3. Minimum Fine:  Two or More Previous Convictions Within Three Years
    If it is shown on trial of an alleged offense under this ordinance that within three years prior to the alleged offense date the defendant has been once previously convicted of an offense under this ordinance.
    1. Except as provided by subsection 2 below, upon conviction the defendant shall be fined not less than $500.00.
    2. If it is also shown on trial of the alleged offense that the defendant was not a residential occupant of the property involved at the time of the alleged offense, upon conviction the defendant shall be fined not less than $2,000.00.

8.102 Additional Remedies

If a building or structure is erected, constructed, reconstructed, altered, repaired, converted, or maintained or if a building or other structure, or land is used in violation of any provisions of this ordinance, the city, in addition to any other remedies, may institute the appropriate action to:

  1. Prevent the unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or use;
  2. Restrain, correct, or abate the violation;
  3. Prevent the occupancy of the building, structure, or land; or
  4. Prevent any illegal act, conduct, business, or use on or about the premises.
